Your privacy matters

 

Here at Perivale Sound Radio, your privacy counts for everything. We follow the rules surrounding privacy according to the United Kingdom's Data Protection Act 2018 (GDPR) We cannot cover every eventuality or individual Country's Laws. Therefore it important that you understand that before submitting any data to us. By submitting your data you are agreeing that you accept that the privacy is governed by the Laws of the United Kingdom. In this case English Law applies. Any questions please ask. You can ask by Email by writing to the following address admin@perivale-sound-radio.com Please state clearly the nature of your enquiry, country of residence (Not home address) and if you seek an outcome please tell us what kind of outcome you would like. We will reply to you as quickly as we can. While you are waiting for a reply please do not submit any personally identifiable data unless you are happy to share it. 

How long will we keep your data? Ordinarily we will only keep your data until we have fully answered your enquiry, after which it will be securely deleted. We will only keep your data in the the following circumstances: You give us permission to keep it, It becomes necessary to record it in cases where you submit abusive communications or when you make a request for a song to be played. Any communication that is deemed by us as being abusive will be kept and if necessary will be passed over to the police. There may be other instances when we will keep your data, in most cases we will inform you that we have done so. We will not keep your data for longer than legally permitted unless the data is required for investigation by the police or other authorities. You have the right to have your data deleted without giving a reason. BUT where you have sent an abusive communication you will not be able to have your data deleted. In these circumstances we will tell you why your data may not be deleted.

 

How we deal with malicious, threatening, racial abuse, harassment or other criminal communications

We will keep your data without informing you if you send any communication deemed to be abusive or breaks the law. What we consider to be abuse is (but not limited to) any communication we deem to be unlawful, discriminatory, racial, disability discriminatory, threatening, fraudulent or intending to cause alarm, distress or harassment. This is NOT an exhaustive list and we may review the list at any time without notice. You should be aware that there are several Laws within the United Kingdom that specifically deal with malicious communications. These are (but not limited to)  Malicious Communications Act 1988, Online Safety Act 2023, Protection From Harassment Act 1997. Again this is not an exhaustive list and there may be other legislation that deals with abusive content.

 

Sending us explicit, sexually explicit, grossly offensive, indecent, pornographic, child abuse material in ANY form will be passed straight to the police without notice. You will not be able to request us to delete your data under any circumstances. The list is not exhaustive and may be reviewed at any time without notice.

 

Any submitted data will be treated with due consideration and will be securely stored until it is no longer needed. Your data will not be shared with any other third party(ies) without your express consent. However, we reserve our right to share your data with organisations such as the police in cases where an abusive communication is received. Your data may be shared if we receive a legitimate Court Order. Other than this we will do our utmost to protect your data as far as reasonably possible but cannot acept responsibility (unless the Law says we must) for any unlawful access to our systems.

By submitting your personally identifiable data you agree that we may use it in a way prescribed in Law. You also accept responsibility if you send us your data through a non secure method. If we collect your data for a specific reason then we shall not use it for any other purpose without your permission. For your permission to be valid you must make your intentions clear in an Email. We will not accept any other method of receiving your permission. When we detect a possible breach of the Law we will NOT seek your permission to share your data with the necessary authorities such as the police.

 

Collected Personal Data

Depending for what purpose we need to collect you personally identifiable data, depends on how much data we will need. Since all requests must be prearranged, we will tell you what we need and for how long the data will be held for. Typically if it is a request or requests we will need your name (NOT tag or other alias) the name of the person the dedication is for. We will also need the name of the song title, the artist(s) and any alternative music track. We will also need the date (7 days or more from the date you notify us and we accept your notification) you would like the dedication to be made. We will also need the occasion (i.e. Wedding, birthday, engagement etc) being celebrated. We won't need this information if it's a self dedication. Please indicate if it is a self dedication. We will also need the country, place name (but no personal address) and state/county/region. Since we broadcast on the Internet we may not be able to do the dedication if the data is vague or ambiguous. We will try to contact you to get further information.

On occasions we run a competition where we offer a prize. To facilitate sending you any prize you win you will be requested for your name, postal address including any postal code or ZIP. We will contact you before requesting this kind of data. Once you confirm receipt of the prize we will delete your data collected for this purpose 3 months after you notify us of the receipt of the prize. In any other scenario we will not request this information.
 

Purpose of collecting data

As explained in the above paragraph we will need your data to process the following (but not limited to): Any dedication (whether it's a self dedication or not). Any complaints. Any requests to delete your data (except in instances given above). To send you any prize you have won. Upon request we will tell you when we will automatically delete your data. You should note that you have the right to receive a copy of any data we hold upon our systems in compliance of the Data Protection Act 2018 (GDPR). This only applies to UK residents. If you live in another country outside of the UK we will endeavour to service your request as though you live in the United Kingdom. Any request for data must be accompanied with proof of identity which we will specify before releasing data. We will contact you to inform you about what we need and when you can expect a reply. Other than mentioned here your data will be deleted after the expiry of the period we notify you about. You can only make a Subject Access Request (SAR) by Email since we don't have other methods of you contacting us. Any such request(s) MUST BE MADE FROM THE SAME EMAIL YOU SUBMITTED THE DATA FROM. We cannot accept requests from any other Email address, this is a measure used to protect your data.

 

BY SUBMITTING YOUR DATA TO US YOU ACCEPT AND AGREE TO OUR TERMS AS EXPRESSED IN THE ABOVE PARAGRAPHS. IF YOU DON'T AGREE OR ACCEPT THE TERMS THEN YOU MUST NOT SUBMIT YOUR DATA.
